APOLLO’S STORE

Who we are:  APOLLO’S PAD is a trading name of Galleon Holdings PLC, a public listed company incorporated in England and Wales with its registered office at 2nd Floor, Hogarth Centre, Hogarth Lane, London W4 2QN (“we” or “us”).  Galleon Holdings PLC owns and operates the website at www.apollospad.com (the “Website”).

Please read these terms carefully.  They are an essential condition of sale.  By purchasing anything from our Website you (“you”) are confirming that you agree to everything set out here.  Your purchases and your use of the Website is also governed by the Apollo’s Pad Terms of Use ("Terms of Use"), which are incorporated herein by reference.

Changes to these Terms of Sale: We may make changes to these Terms of Sale at any time by posting a new version on the Website.  Therefore, we recommend that you review them each time before you make any purchases to ensure that you know what you are agreeing to.  

Eligibility:
To make a purchase you must be:

• A registered member of Apollo’s Pad (you can join for free when making your purchase)
• An end user customer
• Over 18 years old and be able to legally make a purchase with a credit card OR between 13 and 17 years old but be supervised by a parent or guardian
• We may refuse or cancel orders or terminate accounts, at any time in our sole discretion.  You will not be charged for such orders.

 
Payment Method and Terms
You agree to pay for all products and downloads that you purchase through the Website.  When you click on an item in Apollo's Shop, a menu will appear to show you more detail.  You may be given various purchase and download options.  Simply click on the option that you wish to purchase.  

You will be able to pay by Visa, MasterCard, American Express, Discover and Diner's Club credit cards and certain debit cards, as forms of payment. Please follow the on-site instructions on the Website.  By submitting an order via the Website you are authorising us (or our payment processor) to charge the account that you specify for the purchase amount.  

We will not store your credit card details, which will only be used for the purposes of processing your payment.  

Currency
All payments will be charged in UK Sterling.

Prices and VAT
The total price you pay for products or downloads via the Website will include the designated price of what you are buying plus any applicable VAT and other charges notified to you as being accrued through your use of the Website.  We reserve the right to change our prices at any time and do not provide any price protection or refunds in the event of a price reduction or promotional offer.  Prices are valid up to the point of purchase, subject to errors as explained below.

Taxes
Prices include all taxes payable for eligible purchases.

Payment security
We use Secpay Ltd for our transaction security.  If you believe that your credit card has been used fraudulently or otherwise without your permission, please contact your card issuer immediately and also let us know urgently.

Delivery of your order
Once your payment has been completed, we will process your order.  We aim to process your order promptly.  For tangible products, we will aim to despatch your merchandise within 2 days.  For downloads, we will make your download available online via the download page and will send you a link by email.  We will also aim to email you an order summary and a receipt for your purchase within 1 business day.  Please print and keep these for your records.

Delivery of downloads
With respect to downloads that you purchase through the Website, you acknowledge and agree that upon making them available to you (or to their intended authorised recipients), we will have fully satisfied our obligation to deliver or otherwise provide them, regardless of any failure or inability on your part to use such downloads.  Because you will be able to access our downloads as soon as you purchase them, you will not be able to cancel such purchases.  All sales are final.

Delivery and returns of tangible goods
We will ship any tangible goods that you buy through the Website ‘FOB Shipping Point’.  Title to such products passes from us to you on shipment.

All tangible merchandise, other than customised or special orders and as otherwise noted by us, may be returned to us for a refund of your purchase price when you notify us within 10 days of receipt of your order.  You shall be responsible for paying shipping costs to the designated UK location.

We do not accept returns after this 10-day period.  Please telephone us for a return authorisation number, as no merchandise can be returned without a written authorisation number.

Returned items must be unopened, in new condition, and returned in original shipping containers.  

Please inspect all merchandise when it is delived. If any box looks dented or damaged in any way, the driver must make a notation and should mark any damages.  We will not be responsible for damage incurred during shipping.  

Product Descriptions, Availability, Errors
We may change the products and downloads available through the Website at any time.  We cannot guarantee that a product or download will be available.  If necessary, we may cancel any order.

We attempt to be as accurate as possible and eliminate errors however errors may occur and we may have to correct such error and revise your order accordingly if necessary (including charging the correct price).  In these circumstances you will be given the option to cancel or amend your order.  Your sole remedy in the event of an error is to cancel your order and obtain a refund or credit as explained above.

Intellectual property
Your use of the content of any products or downloads that you purchase from the website are subject to our Terms of Use and any other terms indicated on or in the products or downloads.  You agree to indemnify and hold us, our subsidiaries and affiliates, and each of their directors, officers, agents, contractors, partners and employees, harmless from and against any loss, liability, claim, demand, damages, costs and expenses, including reasonable legal fees, arising out of or in connection with your unlawful use of any product or downloads, or any violation of these Terms of Sale or of any law or the rights of any third party.

Hardware
You acknowledge that use of any products or downloads purchased through the Website may require the use of other hardware and software products and that such hardware and software is your responsibility. Once purchased, it is your responsibility not to lose, destroy, or damage the products or downloads.

Disclaimers
WE DO NOT GIVE WARRANTIES ON ANY PRODUCTS OR DOWNLOADS PURCHASED THROUGH THE WEBSITE.  THIS DOES NOT AFFECT ANY WARRANTY OFFERED BY THE ORIGINAL MANUFACTURER ONLY AND NOT BY US.  

YOUR STATUTORY RIGHTS ARE NOT AFFECTED.

General terms and conditions

• All sales and purchases via the Website are governed by English law and the English courts shall have jurisdiction over any disputes arising between you and us.
• If any part of these Terms of Sale are held invalid or unenforceable this will not affect the remaining terms.
• We may assign our rights and obligations to you under these Terms of Sale at any time without notice.
• These Terms of Sale, including the Terms of Use, constitute the entire agreement between you and us regarding purchases you make on the Website.
• Our failure to exercise or enforce any right or provision of these Terms of Sale shall not constitute a waiver of such right or provision in that or any other instance.
• If any provision of these Terms of Sale shall be deemed unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms of Sale and shall not affect the validity and enforceability of any remaining provisions.
• In the event of a conflict between these Terms of Sale and the Terms of Use, these Terms of Sale shall prevail.
